Agreement to Terms 

These Terms of Service ("Terms") constitute a legally binding agreement between you and Online Nurse Training ("Company," "we," "us," or "our") concerning your access to and use of our mobile applications and services. 

Our Applications: 

These Terms apply to all Online Nurse Training mobile applications, courses and services, including (but not limited to): 

• Nursing Dosage Calc Quiz (iOS & Android) 
• NCLEX RN Prep (Coming Soon) 
• NCLEX PN Prep (Coming Soon) 
• Any future Online Nurse Training applications and services 

By accessing or using any of our applications, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use our applications. 

Eligibility 

You must be at least 18 years old to use our applications. By using any of our applications, you represent and warrant that: 

• You are at least 18 years of age 
• You have the legal capacity to enter into these Terms 
• You will comply with these Terms and all applicable laws and regulations 
• All information you provide is accurate and truthful 

If you are using our applications on behalf of an organization, educational institution, or entity, you represent and warrant that you are authorized to accept these Terms on their behalf. 

Account Registration and Security 

Creating an Account 

To access certain features of our applications, you must register for an account by providing: 

• A valid email address 
• A secure password 
• Your name 
• Any other required information 

One account provides access to all Online Nurse Training applications where you maintain active subscriptions. 

Account Responsibilities 

You are responsible for: 

• Maintaining the confidentiality of your account credentials 
• All activities that occur under your account 
• Notifying us immediately at support@onlinenursetraining.com of any unauthorized access or security breach 
• Ensuring your account information is accurate and up-to-date 
• Signing out of your account when using shared devices 

Account Restrictions 

You may not: 

• Share your account credentials with others 
• Allow others to use your account 
• Create multiple accounts for the same individual 
• Use another person's account without permission 
• Create an account using false or misleading information 
• Transfer, sell, or share your account with another person 
• Use automated systems or bots to create accounts 

Violation of these restrictions may result in immediate account termination. 

Subscription and Payment Terms 

Free and Premium Features 

Our applications offer both free and premium subscription options. Features vary by application. 

Nursing Dosage Calc Quiz: 

Free Version: 

• Limited access to quiz questions (up to 5 questions per quiz) 
• Basic dosage calculation categories 
• Limited quiz attempts 

Premium Subscription: 

• Unlimited quiz questions (up to 20 questions per quiz) 
• Access to all 5 calculation categories 
• Unlimited quiz attempts 
• Full quiz history tracking 
• Detailed performance analytics 

NCLEX RN/PN Prep Apps (when launched): 

• Free and premium features to be announced 
• Pricing may differ from Dosage Calc Quiz 

Subscription Plans 

Premium subscriptions are currently available for Nursing Dosage Calc Quiz: 

• Monthly Subscription: $9.99/month (billed monthly) 
• Annual Subscription: $59.99/year (billed annually) 

Additional applications may offer different pricing. All prices are displayed in USD and are subject to change with notice. Price changes will not affect active subscriptions until renewal. 

Bundle subscriptions across multiple applications may be offered in the future. 

Payment Processing 

• All payments are processed through the Apple App Store or Google Play Store 
• You agree to pay all fees associated with your chosen subscription plan 
• Payment will be charged to your App Store or Play Store account at confirmation of purchase 
• We do not have access to your payment information 
• Taxes may apply based on your location 

Auto-Renewal 

Subscriptions automatically renew unless you cancel: 

• Your subscription will automatically renew at the end of each billing period 
• Your account will be charged within 24 hours prior to the end of the current period 
• You will be charged at the then-current subscription rate 
• Auto-renewal can be turned off at any time through your App Store or Play Store account settings 
• Cancellation must occur at least 24 hours before the end of the current period to avoid charges 

To cancel auto-renewal: 

• iOS: Settings → [Your Name] → Subscriptions → [App Name] → Cancel Subscription 
• Android: Play Store → Menu → Subscriptions → [App Name] → Cancel Subscription 

Refunds 

App Store Managed Refunds: 

• All refund requests must be made through the Apple App Store or Google Play Store 
• We do not process refunds directly 
• Refund eligibility is determined by Apple or Google according to their respective policies 
• Subscription cancellation does not automatically result in a refund 
• Contact Apple or Google customer support for refund requests 

No Refunds for Partial Periods: 

• If you cancel your subscription, you will retain access until the end of your current billing period 
• No refunds or credits will be issued for partial subscription periods 
• Unused time is not refundable 

Free Trials 

If we offer free trials for any application: 

• Trial duration will be clearly displayed before sign-up 
• You must provide payment information to start the trial 
• You will be charged automatically when the trial ends unless you cancel at least 24 hours before trial expiration 
• One free trial per user per application 
• Free trial availability may vary by application and region 

Educational Content and Use 

Purpose of Our Applications 

Online Nurse Training applications are designed as educational study aids for nursing students and healthcare professionals preparing for examinations and seeking to improve their clinical knowledge and skills. 

Educational Disclaimer 

IMPORTANT: READ CAREFULLY 

Our applications and their content: 

• Are for educational and practice purposes only 
• Do NOT provide medical advice, diagnosis, or treatment 
• Do NOT replace professional medical education, clinical training, or licensed instruction 
• Should NOT be used as the sole preparation for licensing examinations (NCLEX-RN, NCLEX-PN, or any other certification exams) 
• Should NOT be used for making clinical decisions in patient care settings 
• May contain errors, omissions, or become outdated 

By using our applications, you acknowledge and agree that: 

• You will not rely solely on our applications for medical decision-making or patient care 
• You will consult qualified healthcare educators, licensed professionals, and authoritative sources 
• Clinical practice must follow current evidence-based guidelines and institutional policies 
• Dosage calculations and all clinical decisions in real-world settings require independent verification by licensed professionals 
• You are responsible for ensuring your knowledge and skills meet the standards required for professional practice 
• We are not responsible for examination results, licensing outcomes, or clinical performance 

Content Accuracy 

While we strive for accuracy and regularly review our content: 

• We make no guarantee that all information is error-free, current, or complete 
• Educational content may not reflect the most recent research, guidelines, or standards 
• Calculation methods and clinical practices may vary by institution, region, or clinical setting 
• You are responsible for verifying all information with authoritative and current sources 
• We are not liable for any errors, omissions, or outdated information in our educational content 

We encourage users to report any errors or concerns to support@onlinenursetraining.com. 

Content Updates 

• We regularly update and improve our educational content 
• New questions, categories, and features may be added over time 
• Content may be modified, removed, or replaced without notice 
• We are not obligated to maintain any specific content indefinitely 

Intellectual Property Rights 

Our Content 

All content in our applications, including but not limited to: 

• Quiz questions, answers, and rationales 
• Practice exam questions and explanations 
• Educational text, graphics, images, and multimedia 
• Logos, trademarks, and branding 
• Software code, algorithms, and functionality 
• Database structure and organization 
• User interface design 

is owned by Online Nurse Training or our licensors and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. 

Limited License 

We grant you a limited, non-exclusive, non-transferable, revocable license to: 

• Access and use our applications for personal, non-commercial educational purposes 
• Download and view content on your personal devices as permitted by the applications 
• Use the applications in accordance with these Terms 

This license does not include any right to: 

• Modify, reproduce, or distribute application content 
• Create derivative works based on our content 
• Use our content for commercial purposes 
• Access our applications through automated means 

Restrictions 

You expressly agree NOT to: 

• Copy, reproduce, distribute, or publicly display any content from our applications without written permission 
• Modify, reverse engineer, decompile, or disassemble our applications or any part thereof 
• Create derivative works based on our applications or content 
• Sell, rent, lease, sublicense, or transfer your rights to access our applications 
• Use automated tools, bots, scrapers, or data mining tools to access or collect data from our applications 
• Remove, obscure, or alter any copyright, trademark, or proprietary notices 
• Use our applications or content for any commercial purpose without authorization 
• Share quiz questions, answers, or other content outside the applications 
• Screenshot, record, or otherwise copy content for distribution to others 
• Circumvent any security features or access controls 
• Use our content to create competing products or services 

Violation of these restrictions may result in immediate termination of your account and legal action. 

User Content 

If you provide feedback, suggestions, or other content to us: 

• You grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate such content 
• You represent that you have the right to provide such content 
• We are not obligated to use or implement any suggestions 

Prohibited Conduct 

You agree NOT to use our applications to: 

• Violate any applicable laws or regulations 
• Infringe on intellectual property rights of others 
• Impersonate any person or entity 
• Harass, abuse, threaten, or harm other users 
• Transmit viruses, malware, or other malicious code 
• Attempt to gain unauthorized access to our systems, other user accounts, or computer networks 
• Interfere with or disrupt our applications, servers, or networks 
• Use our applications to cheat on actual examinations or licensing tests 
• Share premium content with non-subscribers 
• Create "study groups" to share a single subscription among multiple people 
• Scrape, data mine, or systematically extract content from our applications 
• Use our applications in any way that could damage our reputation or business 
• Engage in any fraudulent activity related to payments or subscriptions 

Violation of these prohibitions may result in: 

• Immediate account suspension or termination 
• Forfeiture of any subscription fees paid 
• Legal action and pursuit of damages 
• Reporting to appropriate authorities 

Third-Party Services and Links 

Our applications integrate with and may contain links to third-party services: 

• Firebase (Google) - Database, authentication, and analytics 
• RevenueCat - Subscription management 
• Apple App Store - iOS payment processing 
• Google Play Store - Android payment processing 

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for: 

• The content, accuracy, or practices of third-party services 
• Any damages or losses caused by third-party services 
• Changes to third-party services that affect our applications 

We do not endorse and are not responsible for any third-party content, products, or services. 

Disclaimer of Warranties 

THE APPLICATIONS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: 

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT 
• WARRANTIES THAT THE APPLICATIONS WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE 
• WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF CONTENT 
• WARRANTIES THAT DEFECTS WILL BE CORRECTED 
• WARRANTIES THAT THE APPLICATIONS ARE FREE FROM VIRUSES OR HARMFUL COMPONENTS 
• WARRANTIES REGARDING RESULTS OR OUTCOMES FROM USE OF THE APPLICATIONS 

WE DO NOT WARRANT THAT: 

• The applications will meet your specific requirements or expectations 
• Use of the applications will result in passing any examination or achieving any specific outcome 
• The applications will be available at all times without interruption 
• All content is accurate, complete, current, or reliable 
• Any errors or defects will be corrected 

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. 

Limitation of Liability 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: 

ONLINE NURSE TRAINING, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO: 

• LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES 
• DAMAGES FOR BUSINESS INTERRUPTION 
• LOSS OF EDUCATIONAL OR PROFESSIONAL OPPORTUNITIES 
• FAILURE TO PASS EXAMINATIONS, LICENSING TESTS, OR ACHIEVE CERTIFICATION 
• CLINICAL ERRORS, MEDICAL MISTAKES, OR PATIENT HARM RESULTING FROM USE OF OUR APPLICATIONS 
• PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM USE OF THE APPLICATIONS 
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA 
• STATEMENTS OR CONDUCT OF ANY THIRD PARTY 

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR USE OF OUR APPLICATIONS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER. 

THE LIMITATIONS IN THIS SECTION APPLY WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. 

Indemnification 

You agree to indemnify, defend, and hold harmless Online Nurse Training, its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to: 

• Your use or misuse of our applications 
• Your violation of these Terms 
• Your violation of any third-party rights, including intellectual property rights 
• Your violation of any applicable laws or regulations 
• Any content you submit through our applications 
• Your account or use of your account credentials 

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims. 

Termination 

Termination by You 

You may terminate your account at any time by: 

• Canceling your subscription through App Store or Play Store settings 
• Deleting your account through the application settings 
• Contacting us at support@onlinenursetraining.com 

Upon cancellation: 

• You retain access until the end of your current billing period 
• Your data will be deleted within 30 days after the subscription period ends (unless legal retention is required) 
• No refunds will be issued for unused subscription time 
• You must cease all use of our applications 

Termination by Us 

We reserve the right to suspend, disable, or terminate your account and access to our applications immediately, with or without notice, for any reason, including but not limited to: 

• Violation of these Terms or our policies 
• Fraudulent activity or payment disputes 
• Abuse or misuse of our applications 
• Harassment or harm to other users 
• Illegal activity 
• Extended periods of inactivity 
• Required by law or government authority 
• Discontinuation of our applications or services 

Upon termination by us: 

• Your access will be immediately revoked 
• Your data may be deleted 
• No refunds will be issued for any remaining subscription period 
• You must cease all use of our applications 
• Outstanding amounts owed become immediately due 

Effect of Termination 

Upon termination of your account for any reason: 

• All licenses granted to you under these Terms will immediately cease 
• You must stop all use of our applications 
• Sections of these Terms that by their nature should survive termination will continue to apply 

Modifications to Applications and Terms 

Changes to the Applications 

We reserve the right to: 

• Modify, suspend, or discontinue any feature, functionality, or content of our applications at any time 
• Release new applications or retire existing applications 
• Change subscription prices (with notice to existing subscribers before renewal) 
• Update educational content, questions, and study materials 
• Improve functionality and user experience 
• Impose limits on certain features or restrict access to parts of our applications 

We will make reasonable efforts to notify users of material changes, but we are not obligated to maintain any specific features or content indefinitely. 

Changes to These Terms 

We may update these Terms from time to time to reflect changes in our practices, applications, legal requirements, or for other operational reasons. When we make material changes: 

• We will update the "Last Updated" date at the top of these Terms 
• We will notify you via email or in-app notification 
• For material changes, we may require you to accept the updated Terms to continue using our applications 
• Your continued use of our applications after changes are posted constitutes acceptance of the updated Terms 

If you disagree with any changes to these Terms, you must stop using our applications and cancel your subscription. 

We encourage you to review these Terms periodically to stay informed of updates. 

Dispute Resolution 

Governing Law 

These Terms and any disputes arising from or related to these Terms or our applications shall be governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to its conflict of law provisions. 

Informal Resolution 

Before filing any formal legal action, you agree to first contact us at support@onlinenursetraining.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute by contacting you via email within 7 business days. 

Both parties agree to negotiate in good faith for at least 30 days before pursuing formal legal action. 

Jurisdiction and Venue 

Any legal action or proceeding arising from or related to these Terms or our applications shall be brought exclusively in the federal or state courts located in Milwaukee County, Wisconsin, and you consent to personal jurisdiction in such courts. 

CLASS ACTION WAIVER 

YOU AND ONLINE NURSE TRAINING AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION. 

You agree that you will not participate in a class action or class-wide arbitration for any claims covered by these Terms. You also agree not to seek to combine any action with any other action without the consent of all parties to these Terms and all other actions. 

Limitation on Time to File Claims 

Any claim or cause of action arising from or related to use of our applications or these Terms must be filed within one (1) year after the claim or cause of action arose, or it will be permanently barred. 

General Provisions 

Entire Agreement 

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Online Nurse Training regarding our applications and supersede any prior agreements, understandings, or representations. 

Severability 

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable. 

Waiver 

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights or provisions. Any waiver of any provision of these Terms will be effective only if in writing and signed by Online Nurse Training. 

Assignment 

You may not assign, transfer, or sublicense these Terms or any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction. 

Force Majeure 

Online Nurse Training shall not be liable for any failure to perform its obligations under these Terms due to causes beyond its reasonable control, including but not limited to: 

• Acts of God (natural disasters, severe weather) 
• War, terrorism, riots, or civil unrest 
• Government actions, embargoes, or sanctions 
• Strikes or labor disputes 
• Network infrastructure failures 
• Cyber attacks or data breaches affecting third-party services 
• Pandemics or public health emergencies 
• Failures of third-party services (Firebase, RevenueCat, App Stores)

Any obligations or liabilities incurred prior to termination will also survive. 

Headings 

The section and paragraph headings in these Terms are for convenience only and have no legal or contractual effect. 

Language 

These Terms are written in English. Any translations are provided for convenience only. In the event of any conflict between the English version and a translation, the English version shall prevail. 

DMCA Copyright Policy 

We respect intellectual property rights and expect our users to do the same. If you believe that content in our applications infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA).

Your notice must include: 

• Your physical or electronic signature 
• Identification of the copyrighted work you claim has been infringed 
• Identification of the material that you claim is infringing and where it is located in our applications 
• Your contact information (address, telephone number, email address) 
• A statement that you have a good faith belief that use of the material is not authorized by the copyright owner 
• A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner 

We will respond to valid DMCA notices in accordance with applicable law and may remove or disable access to allegedly infringing material.
